Terms of Service

These terms govern your use of ClustraNotes, a service for students to discover and share study material. Read them before creating an account or uploading content.

1. About these terms

ClustraNotes is operated by Divam Dubey. These terms apply when you access or use the website or app. By creating an account or using the service, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service. We may use website analytics and similar operational tools to understand usage patterns, maintain security, and improve the service, as described in our Privacy Policy.

ClustraNotes may be in development or early access. Features may be changed, suspended, or withdrawn, and joining an early-access list does not guarantee access or availability of any particular feature.

2. Eligibility and accounts

  • You must be at least 18 years old to use the service.
  • You must provide accurate information and keep it reasonably up to date.
  • Keep your account credentials secure and do not share or misuse another person's account. You are responsible for activity through your account to the extent permitted by law.
  • Notify us promptly if you suspect unauthorised access to your account.

3. Your content and our licence

You retain ownership of content you create and upload, subject to any rights held by third parties. When you upload content, you grant ClustraNotes a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display, and distribute that content as reasonably necessary to operate the service and provide the features you choose. This includes creating previews and thumbnails and processing content through service providers acting on our behalf.

You choose the visibility of each note when uploading it. Notes marked public may become accessible to other users immediately, without prior admin approval. Where enabled, other users may view, download, or share public notes.

You must have the rights and permissions necessary to upload and share your content with the selected audience. You may delete your content using the available features, subject to applicable restrictions and legal retention requirements. Removing content from ClustraNotes cannot recall copies already downloaded or independently redistributed by other users.

4. Content you may upload

Upload only material you created yourself or have the right to share, including material covered by permission or an applicable open licence. You are responsible for checking the rights and restrictions that apply to each upload.

Do not upload or share content that:

  • infringes copyright, trademarks, privacy, publicity, or other rights, or contains third-party material without permission or a lawful basis;
  • violates examination rules, facilitates cheating, or unlawfully discloses confidential academic material;
  • is unlawful, threatening, harassing, defamatory, hateful, sexually exploitative, or otherwise harmful, including content harmful to children;
  • exposes personal or confidential information without a lawful basis or appropriate permission;
  • impersonates another person or materially misleads users;
  • contains malware, viruses, or code intended to harm systems or data;
  • otherwise violates applicable law or these terms.

5. Content visibility, review, and removal

Content is made available according to the visibility and sharing options presented in the service. Before uploading, check the selected visibility and the information attached to the contribution.

We may review, restrict, disable access to, or remove content, and may suspend or terminate accounts, where reasonably necessary to enforce these terms, investigate a report, protect users or the service, or comply with applicable law. We do not promise to pre-screen every upload or to detect every violation.

We will process valid court orders, government directions, and other legal requests in accordance with the requirements and deadlines that apply to the particular request. Where appropriate and legally permitted, we may notify the uploader or provide an opportunity to respond.

If you believe content was removed or restricted in error, contact the grievance officer in Section 12 and include enough information for us to identify and review the decision.

7. Student-created material and disclaimers

Notes and other study material may be provided by users rather than by ClustraNotes or your educational institution. We do not guarantee that user content is accurate, complete, lawful, original, or up to date. It does not replace official course materials or advice from your institution.

A label such as “reviewed” or “verified”, if used, describes the scope of the review actually performed; it is not a guarantee of academic accuracy or endorsement by an institution.

8. Acceptable use

You must not:

  • use bots, scrapers, or automation to collect content in bulk without our permission;
  • attempt to bypass access controls, rate limits, or security measures;
  • interfere with the service, overload it, or test it without authorisation;
  • spam, threaten, harass, or abuse other users;
  • use another person's account or misrepresent your identity;
  • use the service for unlawful activity or to violate another person's rights.

9. ClustraNotes intellectual property

The ClustraNotes name, branding, logo, software, and service design, excluding user content and third-party materials, are owned by or licensed to the operator and are protected by applicable law. These terms do not grant you ownership of those materials. You may not copy, modify, distribute, or use them except as permitted by law or with our written permission.

10. Availability, disclaimers, and liability

We work to keep ClustraNotes available and secure, but we do not guarantee uninterrupted, error-free, or continuous operation. Features may change as we develop the service.

To the extent permitted by applicable law, the service is provided on an “as available” basis, and we disclaim warranties that cannot reasonably be given for a developing user-content platform. We are not responsible for user content or for copies users save outside the service. Nothing in these terms excludes or limits liability or rights that cannot lawfully be excluded or limited.

11. Suspension, termination, and deletion

You may stop using the service and request account deletion through the available account controls or by contacting us. We may restrict, suspend, or terminate access where reasonably necessary for a serious or repeated violation of these terms, security concerns, or compliance with applicable law.

Following account or content deletion, some records may remain for a limited period in backups or where needed to address disputes, enforce these terms, or comply with law. Content already downloaded by other users may not be recoverable or removable by us. Terms that by their nature should continue, including provisions concerning intellectual property, accrued claims, and liability, survive termination to the extent applicable.

12. Contact and grievance officer

For complaints, content reports, or questions about these terms, contact:

We will handle complaints under the grievance process and timelines applicable to the service and the particular complaint. Please include sufficient details for us to identify the issue. Nothing in this section limits rights or remedies available under applicable law.

13. Changes and governing law

We may update these terms as the service or applicable law changes. We will take reasonable steps to communicate material changes through the website, app, or email where appropriate. The current version will be available on this page. Continued use after updated terms take effect will be handled in accordance with applicable law.

These terms are governed by the laws of India. Subject to any non-excludable legal rights and jurisdictional requirements, disputes may be brought before the competent courts in Bengaluru.
